TÉRMINOS Y CONDICIONES DE USO

Lea atentamente los Términos y Condiciones Generales (en adelante los “TyCG”) antes de acceder o utilizar el Sitio web https://www.tradinglab.es/academy (en adelante, denominada, la “Academia”). Los siguientes TyCG regulan, la descarga, acceso, navegación y uso de la Academia. 

Se entienden como vigentes, las condiciones que estén publicadas en el momento en el que el Usuario Cliente acceda a la Academia.

Si alguna disposición de los presentes TyCG se declarase inaplicable o inválida, dicha disposición será limitada o eliminada en la medida mínima necesaria para que las restantes condiciones y obligaciones permanezcan en pleno vigor y efecto y de obligado cumplimiento.

TRADING LAB podrá suprimir, modificar o sustituir los contenidos del presente documento en cualquier momento, publicando o enviando una notificación a través de la Academia o por correo electrónico, sin posibilidad por parte del Usuario Cliente de exigir indemnización alguna.

TRADING LAB puede traducir los presentes Términos y Condiciones o cualquier otra política que pueda ser publicada en la Academia. La versión en español será la que prevalezca en caso de conflicto con otras traducciones. 

ACEPTACIÓN DE LOS TÉRMINOS Y CONDICIONES

1. Al registrarse y utilizar la Academia el Usuario (en adelante, “Usuario” o “Usuario Cliente”) acepta y se compromete a cumplir con todos los TyCG establecidos en este Acuerdo. Se considerará como Usuario de la Academia a cualquier individuo registrado o que haga uso de la misma. Cualquier persona tiene la posibilidad de registrarse o utilizar la Academia, siempre y cuando acepte los TyCG, así como todas las demás políticas y principios que rigen el funcionamiento de la Academia y que se detallan a continuación.

2. Al aceptar los TyCG, los Usuarios se comprometen a actuar siempre conforme a las disposiciones establecidas en el presente documento legal y la normativa correspondiente. En caso de desacuerdo total o parcial con estos TyCG, los Usuarios deben abstenerse de instalar y utilizar la Academia.

3. El servicio ofrecido en esta Academia está sujeto a: (i) los presentes Términos y Condiciones Generales; (ii) Condiciones Particulares que puedan ser publicadas en la Academia y que pueden sustituir, completar y/o modificar los presentes TyCG; (iii) las leyes vigentes y aplicables, y los criterios y prácticas generales.

4. TRADING LAB se reserva el derecho de modificar la presentación, configuración y contenido de la Academia, así como las condiciones necesarias para su acceso y/o utilización. El acceso y uso de los contenidos y servicios después de la entrada en vigor de dichas modificaciones o cambios en las condiciones implican la aceptación de los mismos.

DATOS DEL TITULAR DE LA ACADEMIA

1. En cumplimiento con el deber de información recogido en el artículo 6 de la Ley 20/2014, de 16 de octubre, reguladora de la contratación electrónica y de los operadores que desarrollan su actividad económica en un especio digital (“Llei 20/2014, del 16 d’octubre, reguladora de la contractació electrònica i dels operadors que desenvolupen la seva activitat econòmica en un espai digital”), le detallamos a continuación los datos del titular de la Academia:

• Titular: DELANIETA, SLU (en adelante, “TRADING LAB”).
• NRT: L-718309-P
• Domicilio Social: Mirador d’Encamp, número 16, Encamp (AD200), Principado de Andorra.

USO DE LA ACADEMIA

1. TRADING LAB proporciona al “Usuario Cliente” que esté interesado en contratar los Servicios de la Academia, y que haya superado satisfactoriamente la llamada de cualificación de su perfil, así como la llamada de admisión realizada por los profesionales de TRADING LAB (el “Proceso de Selección de Usuarios”) la posibilidad de acceder a la Academia y a sus contenidos según el plan de suscripción que tenga contratado.  

2. Los TyCG, así como las Políticas de Privacidad y cualquier otra información relacionada con la Academia, son de aplicación para todos Usuario Cliente desde el momento inicial de su acceso a la misma. Estos TyCG tienen carácter obligatorio, son vinculantes y se extienden a todas las actividades realizadas en la Academia.

3. Los Usuarios Clientes son responsables de garantizar que todas las personas que accedan a la Academia a través de su conexión a internet estén informadas sobre los TyCG y cumplan con los mismos. 

4. Los Usuarios Clientes manifiestan que la intervención y/o vinculación a través de la Academia no genera ningún tipo de relación laboral con TRADING LAB.

5. El Usuario Cliente tiene la potestad de acceder a través de la Academia a toda la información necesaria relacionada con la misma según los Servicios que haya contratado. Desde este punto, puede explorar y examinar a fondo su funcionamiento.

6. El Usuario Cliente se obliga asimismo a abstenerse de utilizar la Academia con fines o efectos ilícitos o contrarios a lo establecido en los TyCG.

SERVICIOS

La Academia permite que el Usuario Cliente tenga acceso a las siguientes categorías de contenidos (los “Servicios”):

1. Contenidos formativos:

• Módulos y episodios de la formación que el Usuario Cliente ha adquirido.
• Recursos descargables o no descargables asociados a la formación adquirida por el Usuario Cliente.

2. Contenidos bajo suscripción:

• Acceso a grabaciones de mentorías y clases grupales en directo que se realizan cada semana en la comunidad.
• Acceso al servidor de Discord desde donde se desarrolla la actividad de la comunidad.
• Vinculación y/o modificación de la cuenta del cliente en Discord con la Academia para poder acceder de forma correcta al servidor de Discord.
• Herramientas y/o recursos extra que se puedan incluir en un futuro baja cada suscripción.

3. Acceso a páginas funcionales:

• Incluyendo los ajustes, donde el Usuario Cliente pueda modificar su información personal (correo electrónico, nombre, apellido, contraseña, etc.).
• Servicio de soporte, a través del cual el Usuario Cliente puede hacer consultas referentes a la Academia.

REGISTRO EN LA ACADEMIA

1. Para poder proceder al registro en la Academia, el Usuario Cliente debe previamente proceder al pago utilizando el enlace proporcionado por el agente de TRADING LAB a través del cual accederá a un checkout. Dicho checkout es externo a TRADING LAB y es gestionado por Hotmart, cuyos términos y condiciones de uso pueden consultarse en el siguiente enlace: https://hotmart.com/es/legal/terminos-de-uso

2. De conformidad con los términos y condiciones de uso de Hotmart, el Usuario Cliente deberá proporcionar los siguientes datos: nombre y apellidos, correo electrónico, información de pago.

3. TRADING LAB no asume responsabilidad por cualquier incidencia derivada del uso de Hotmart por parte del Usuario Cliente.

4. El Usuario Cliente garantiza que la información proporcionada durante el proceso de registro es precisa, completa y actualizada.

5. TRADING LAB garantiza a los Usuarios Clientes que sus datos de carácter personal únicamente con el fin de ejecutar los servicios contratados por el Usuario Cliente en la Academia. Los datos no se divulgarán a terceros salvo en aquellos casos en los que exista una obligación legal o en caso de que exista el correspondiente contrato de transferencia y cesión de datos personales con terceros que garantice el cumplimiento de todas las garantías en materia de protección de datos con las empresas colaboradoras (tales como Hotmart). En cualquier caso, los datos se almacenarán durante el tiempo necesario para el cumplimiento de este propósito y para determinar posibles responsabilidades que pudieran derivarse de tal fin y del tratamiento de los datos.

6. Una vez efectuado el pago, el Usuario Cliente recibe un email con los datos de acceso a la Academia de TRADING LAB. Con dichos datos de acceso el Usuario Cliente puede acceder a la Academia y a sus contenidos. 

7. TRADING LAB no puede asegurar la identidad de los Usuarios Clientes registrados y no asume responsabilidad por el uso indebido o no autorizado de un Usuario Cliente registrado por parte de terceros. 

8. El Usuario Cliente registrado será responsable en todo momento de salvaguardar su contraseña de acceso a su cuenta de Usuario, asumiendo, por ende, cualquier daño o perjuicio que pueda derivarse de un uso indebido, así como de la cesión, revelación o extravío de la misma. En caso de tener razones para sospechar que su código de acceso o contraseña ha sido utilizado sin autorización o es susceptible de serlo, el Usuario Cliente debe informar de inmediato a TRADING LAB.

9. En cualquier situación, el acceso y/o uso de la Academia bajo el código de acceso o contraseña del Usuario Cliente registrado se considerará realizado por dicho Usuario Cliente, quien será responsable en todo momento de dicho acceso y uso.

10. TRADING LAB tiene derecho a rechazar cualquier solicitud de registro o cancelar un registro previamente aceptado, sin que esté obligada a comunicar o exponer las razones de su decisión y sin que ello genere derecho a indemnización y/o resarcimiento alguno.

MÉTODOS DE PAGO Y POLÍTICAS DE PRECIO

1. Una vez el Usuario Cliente registrado, este puede seleccionar los contenidos que desea adquirir de entre los ofrecidos por TRADING LAB. Pulsando en cada contenido, se accede a su ficha, que incluye una descripción detallada con la información, características principales y precio. 

2. Una vez seleccionado el/los curso/s que el Usuario Cliente desee contratar, deberá pulsar el botón “Comprar”, quedando incorporado el servicio a su carrito de la compra. Si lo desea, podrá seguir añadiendo más servicios al carrito, o proceder directamente al pago.

3. Concluida la selección del curso, aparecerá un resumen. Finalmente, para continuar, el Usuario Cliente deberá pulsar el botón “Realizar Pedido” y elegir el medio de pago de entre los ofrecidos por TRADING LAB a continuación:

• Tarjeta de crédito o débito.
• Apple Pay.
• Google Pay.
• Criptomonedas. Para realizar el pago con criptomonedas es recomendable ponerse en contacto a través del formulario haciendo clic aquí.

4. Los pagos son procesados a través de la pasarela Hotmart, cuyos términos y condiciones de uso pueden consultarse en el siguiente enlace: https://hotmart.com/es/legal/terminos-de-uso

5. Una vez finalizado el proceso de contratación, Hotmart enviará un correo electrónico confirmando la compra, y en el que se detallarán los datos de la misma, y se adjuntará un justificante de compra o factura. 

6. Los precios están expresados en Euros, y son válidos salvo error tipográfico. En el caso de que se produzca un error manifiesto en la fijación del precio que aparezca en la ficha de servicio, prevalecerá el precio establecido para dicho servicio en el email informativo que TRADING LAB proporcionará al Usuario Cliente cuando detecte el error.

LICENCIA DE USO Y CONTENIDOS

1. TRADING LAB ofrece al Usuario Cliente acceso a TRADING LAB conforme a una licencia limitada, no exclusiva, no sublicenciable, no transferible y revocable. El uso de la Academia TRADING LAB será en todo momento personal y conforme a los presentes TyCG.

2. El Usuario Cliente al hacer uso de los beneficios que la Academia provee, estará dando a TRADING LAB y a sus colaboradores un derecho perpetuo, irrevocable, mundial, no exclusivo, libre de regalías y totalmente sublicenciable y una licencia para usar, reproducir, modificar, adaptar, publicar, traducir, distribuir, realizar y mostrar dichos contenidos, siempre en virtud de los fines propuestos.

3. El Usuario Cliente al utilizar la Academia acepta y entiende que TRADING LAB pueda conservar su contenido durante el tiempo que necesite para completar aquellos propósitos para los cuales fueron recopilados.

4. Cualquier contenido que el Usuario Cliente suba a la Academia será considerado no confidencial y TRADING LAB tiene el derecho de usar, copiar y revelar a terceros dicho contenido para los propósitos predispuestos. TRADING LAB tiene el derecho de revelar la identidad del mismo a cualquier tercero que reclame que cualquier contenido enviado constituye una violación de sus derechos de propiedad intelectual, o su derecho de privacidad.

5. TRADING LAB no se hará responsable ante terceros del contenido o la exactitud de cualquier contenido enviado. TRADING LAB tiene el derecho a eliminar cualquier contenido o anuncio enviado a través de la Academia a su total discreción.

6. TRADING LAB tendrá derecho a investigar y denunciar cualquiera de las conductas mencionadas de acuerdo con la Ley, así como a colaborar con las autoridades en la investigación de dichas actuaciones.

OBLIGACIONES DEL USUARIO CLIENTE

1. Si el Usuario Cliente tuviera conocimiento de la existencia de algún contenido ilícito, ilegal, contrario a las leyes o que pudiera suponer una infracción de derechos de propiedad intelectual y/o industrial, deberá notificarlo inmediatamente a TRADING LAB para que esta pueda proceder a la adopción de las medidas oportunas. Queda expresamente prohibida la utilización de la Academia para fines distintos a los recogidos en los presentes TyCG. Por tanto, TRADING LAB no se responsabiliza por un uso o manipulación inadecuada de la Academia.

2. La Academia puede proporcionar acceso a multitud de textos, gráficos, dibujos, diseños, códigos, software, fotografías, imágenes, expresiones e informaciones pertenecientes a TRADING LAB o a terceros a los que el Usuario Cliente pueda tener acceso. El Usuario Cliente asume la responsabilidad del uso de la Academia y se compromete a hacer un uso lícito, diligente, honesto y correcto de cuanta información o contenidos tenga acceso a través de la Academia, y todo ello bajo los principios de la buena fe y respetando en todo momento a la legalidad vigente y los presentes TyCG.

Con carácter enunciativo, pero no limitativo, los Usuarios deben abstenerse de: 

1. Registrarse o comunicar datos que no sean verdaderos, exactos, completos y/o actualizados, ni acceder a la Academia utilizando el nombre, datos identificativos o las claves de acceso de otro Usuario o suplantar a cualquier persona o identidad. Asimismo, el Usuario Cliente se hace responsable de comunicar a TRADING LAB, cualquier modificación y/o variación de cualquiera de los datos comunicados a TRADING LAB.
2. To cause neither maliciously nor intentionally damages that may impair or alter the Academy, nor will it introduce or spread computer viruses that may cause unauthorized alterations to the contents or systems that make up the Academy. The User must not scan or test the vulnerability of any TRADING LAB system or network, or violate any security or authentication measure, or attempt to decrypt or disassemble the software used by TRADING LAB to provide services through the Academy.

3. Use the Academy for fraudulent purposes, or related to criminal offenses or illegal activities of any kind.

4. Reproduce, copy, distribute, transform or modify the information and content hosted at the Academy, unless authorized by the owner of the corresponding rights.

5. Use the Academy to send, use or reuse material that contains illegal, offensive, pornographic, abusive, indecent, defamatory, obscene or threatening information of any kind, or that involves a violation of copyright, trademark or confidentiality, privacy or any other right, or is otherwise injurious or censorable to third parties, or whose content contains computer viruses, political propaganda, advertising content and, in general, any kind of annoyance or unnecessary inconvenience.

6. Download, send or distribute in any other way content or applications that may violate any legislation in force or that involve violating any right of any party.

7. Promote or encourage third parties to carry out or contribute to any of the above practices.

8. Send and/or upload:

• Defamatory material for anyone.
• Any obscene, offensive, defamatory material.
• Any sexually explicit material.
• Any material that promotes violence
• Any material that promotes discrimination on the basis of race, sex, religion, nationality, disability, sexual orientation, or age.
• Any copyright, database right, or trademark of any other person.
• The privacy rights of any other person.
• The personal data of another person, unless you ensure that that person has consented to be bound by these T&CG.
• Any material that promotes any illegal activity.
• Threats, abuses, or invasion of another person's privacy
• Content that causes discomfort, inconvenience, or unnecessary anxiety.
• Harassment, annoyance, or content that embarrasses, alarms, or upsets anyone else.
• Content that impersonates the identity of another person.

TRADING LAB RESPONSIBILITIES AND GUARANTEES

1. TRADING LAB is not responsible for the information, files or any other content published by Users, nor does it validate the content that Users or decide to submit, so TRADING LAB will not be responsible, either directly or indirectly, or subsidiarily, for damages of any nature derived from the communications made or content included in the Academy.

2. By way of example, TRADING LAB is not responsible for:

• The satisfaction of the Customer User's personal needs or requirements in relation to the resources provided by the Academy.

• Direct or indirect and/or intangible damages, including personal injuries suffered as a result of misuse of the Academy.

• The loss of reputation, image, or data, that may occur while using the Academy.

• The lack of availability, maintenance and effective operation of the Academy, excluding, to the maximum extent permitted by current legislation, any liability for damages of any kind that may be due to the lack of availability or continuity of the operation of the Academy.

• Any defect, error or problem in the functioning of the Academy.

3. Consequently, TRADING LAB does not guarantee that the use that Users may make of the content and services that, if any, are included in the Academy, conforms to these Terms and Conditions, nor that they do so diligently. TRADING LAB cannot guarantee the identity of any other Academy User.

4. TRADING LAB reserves the right of admission and exclusion from its Academy at its own discretion. Specifically, any Client User who does not comply with the rules contained in this condition or makes inappropriate use of the Academy may be excluded from it.

5. TRADING LAB reserves the right to (i) delete, suspend, edit or modify the content of the Academy at its sole discretion, at any time, without notice and for any reason, and (ii) eliminate, suspend or block any use made by the Client User of the Academy.

6. TRADING LAB also reserves the right to read, preserve, disclose and access any information it deems reasonably necessary to (i) comply with applicable legislation or any judicial or governmental request or request, (ii) enforce these T&Cs, including the investigation of potential violations, (iii) detect, prevent or manage fraud, security or technical problems (iv) respond to requests for assistance to the Customer User or (v) protect the rights, property or security of TRADING LAB and its Users.

7. However, TRADING LAB declares that it has adopted all necessary measures, within its possibilities and the state of technology, to guarantee the functioning of the Academy and to prevent the existence and transmission of viruses and other harmful components to Users.

8. Under no circumstances will TRADING LAB be responsible for any damages and/or losses of any kind that Users may suffer as a result of or on the occasion of contracting between them, nor will it be responsible for the terms of contract agreed between the Professional User and the Client User.

9. The Client User, by accepting the service provided by the Professional User through the TRADING LAB Academy, accepts and recognizes that TRADING LAB is not responsible for any act committed by the Users and/or by third parties, including these, but not limited to the withdrawal of contracts for the services provided by the Professional User or the cancellation of such services, delays, losses, lack of the corresponding registration for the exercise of the profession, and others. Users accept that they must be aware and that they approve that when using the services offered by the Academy, they must assume, under their sole responsibility, the risks that this entails.

SUSPENSION AND CANCELLATION OF SERVICES

1. TRADING LAB may temporarily suspend, without prior notice, access to the Academy for maintenance, repair, updating or improvement operations.

2. In particular, TRADING LAB reserves the right to eliminate, limit or prevent access to its Academy when technical difficulties arise due to events or circumstances outside TRADING LAB that, at its discretion, decrease or cancel the standard security levels adopted for the proper functioning of the Academy.

3. TRADING LAB is not responsible for the lack of availability, maintenance and effective operation of the Academy, excluding, to the maximum extent permitted by current legislation, any liability for damages of any kind that may be due to the lack of availability or continuity of the operation of the Academy.

4. TRADING LAB also does not assume responsibility for the cancellation or suspension of services at the Academy for reasons that are not attributable to it. In any case, TRADING LAB is committed to solving any problems that may arise and to offering all the necessary support to the Client User to arrive at a quick and satisfactory solution to the incident.

5. TRADING LAB is not responsible for cases of force majeure, understood as the failure, suspension or interruption of services or use of the Academy, as a result of Internet network blocking, actions or omissions of third parties, or any other causes or circumstances beyond the control of TRADING LAB that prevent the normal use of the Academy.

6. The Application may contain hyperlinks that allow the Client User to access Academies or third-party websites. TRADING LAB assumes no responsibility for the content, information or services that may appear in these Academies, which will be understood to be offered exclusively for informational purposes by TRADING LAB, and which in no case imply any relationship, acceptance or support between TRADING LAB and the people or entities that own such content or owners of the sites where they are located.

7. In these cases, TRADING LAB will not be responsible for establishing the General and particular Terms and Conditions to be taken into account in the use, provision or contracting of these services by third parties and, therefore, cannot be considered responsible for them.

8. TRADING LAB has no power or human or technical means to know, control or approve all the information, content, products or services provided by other web pages to which links can be established from the Academy. Consequently, TRADING LAB cannot assume any type of responsibility for any aspect related to the web pages to which a link may be established from the Academy, specifically, by way of example and not limited to, for their operation, access, data, information, files, quality and reliability of its products and services, its own links and/or any of its content, in general.

9. However, in the event that TRADING LAB becomes aware that the activity or information referred to from these links is illegal, constitutes a crime or may harm the property or rights of a third party, it will act with the necessary diligence to delete or disable the corresponding link as soon as possible.

RIGHT OF WITHDRAWAL OF THE CLIENT USER

1. The Customer User will have the right to unsubscribe from the Academy, at any time, by sending an email, from the address they wish to unsubscribe, to the address hola@tradinglab.es.

2. TRADINGLAB wants satisfaction with the hiring of the Client User. For this reason, it provides you with the option to cancel it (withdrawal). The exercise of this right of withdrawal must be carried out within a maximum period of fifteen (15) calendar days from your registration with the Academy through payment channeled through Hotmart, and in compliance with the requirements expressed in this section.

3. In any case, they do not allow returns:

• Cryptocurrency payments.
• The Client User who has requested access to both training courses (Trading Mastery & Crypto Mastery).
• The Customer User who has accessed the Academy by purchasing training packages, in promotions such as, but not limited to: Black Friday, Cyber Monday, Christmas, etc.

4. In any case, the warranty period of fifteen (15) days does not apply:
   

• To cryptocurrency payments.
• If the Client User has consumed more than fifty percent (50%) of the content.
• If the Customer User has downloaded the bonuses.

5. The reimbursement of purchases must be processed by the Customer User through the Hotmart portal, and will be made by Hotmart once TRADING LAB has verified compliance with the conditions of this clause, through the same payment method used in the purchase, that is, through the Hotmart gateway, and, in any case, within a maximum of thirty (30) calendar days from the reliable receipt of the request for withdrawal.

6. TRADING LAB is not responsible for any incidents in the refunds to be made by Hotmart.

INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

1. The Academy, including but not limited to its programming, editing, compilation and other elements necessary for its operation, the designs, logos, texts and/or graphics mentioned in these T&Cs, are the property of TRADING LAB.

2. Users acknowledge that the reproduction, modification, distribution, commercialization, decompilation, disassembly, use of reverse engineering techniques or any other means to obtain the source code, transformation or publication of any unauthorized reference test result of any of the elements and utilities integrated into the development constitutes an infringement of TRADING LAB's intellectual property rights, thus requiring them not to carry out any of the above-mentioned actions.

3. All the contents of the Academy are duly registered and protected by Intellectual and Industrial Property regulations, as well as legally registered in the corresponding public records. Regardless of the purpose for which they were intended, total, partial reproduction, use, exploitation, distribution and commercialization in any case requires prior, express and written authorization from TRADING LAB.

4. The designs, logos, texts and/or graphics that are not part of TRADING LAB and that may appear on the website or in the application belong to their respective owners, who are themselves responsible for any possible controversy that may arise regarding them.

5. Third parties who hold intellectual and industrial property rights to photographs, logos, and any other symbols or content included in The Academy have granted the corresponding authorizations for their reproduction, distribution and making available to the public.

INDEMNITY

1. Users undertake to protect and exempt TRADING LAB from any damage, liability or cost that may arise from third-party claims against TRADING LAB, its directors, representatives or employees due to material provided by Users, misuse of TRADING LAB services or violation of these T&Cs.

2. TRADING LAB will inform Users of any demand using the data provided when registering for the services. By accepting these T&Cs, Users acknowledge that TRADING LAB has no direct or indirect responsibility for the services contracted between the Professional User and each Client User or third parties.

DATA PROTECTION

1. TRADING LAB undertakes to process the personal data of its Client Users in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, on the protection of individuals with regard to the processing of personal data and the free movement of these data (”RGPD”) and Law 29/2021, of October 18, qualified for the protection of personal data (”Law 29/2021, of October 28, qualified for the protection of personal data”) (”LQPD”).

2. In this regard, Client Users are informed that, in terms of privacy and protection of their personal data, they can exercise the following rights:

• Access your personal data;
• Request the rectification of any inaccurate data;
• Request the deletion of your data;
• Request that the processing of your data be limited;
• Oppose the processing of your data;
• Exercise your right to be forgotten; and
• Request the portability of your data.
• Not to be subject to decisions based solely on automated data processing.

3. The Client User can exercise all these rights at the email address [⋅] the reason for their request and by providing a copy of their identity document or passport.

NULLITY AND EFFECTIVENESS OF CLAUSES

1. If any clause included in these T&CS is declared, in whole or in part, null or ineffective, such nullity or ineffectiveness will affect only that provision or the part of it that is null or ineffective, with the rest of the clauses remaining, with such a clause, or the part of it that is affected, as a result of not being put in place.

RIGHT OF EXCLUSION

1. TRADING LAB reserves the right to deny or withdraw access to the portal and/or the services offered without prior notice, at its own request or at the request of a third party, to those Customers who fail to comply with these General Conditions.

APPLICABLE LEGISLATION AND JURISDICTION

1. These Terms of Contract are subject to the legislation of the Principality of Andorra.

2. In the event of a dispute between the parties, both parties agree to submit to the jurisdiction of the Customer User's place of residence for the resolution of any dispute arising from the established contractual relationship.
